1) Acceptance of terms

These Terms of Service (“Terms”) govern your use of the website, store, and services provided by SquareSole (Squirrel Brands, LLC, “we,” “us,” or “our”). By accessing or purchasing from squaresole.ai, you agree to these Terms. If you do not agree, do not use the Services.

2) Eligibility & account

  • You must be 18+ (or the age of majority in your jurisdiction) to purchase. If 13–17, you may browse only with parent/guardian consent and supervision.
  • You’re responsible for safeguarding any account credentials and for all activity under your account.

3) Orders, pricing & mockups

  • Order acceptance: Your order is an offer to buy. We may accept or decline for any lawful reason (e.g., suspected fraud, stock/print capability, pricing errors).
  • Pricing & errors: We strive for accuracy. If a price, promotion, or availability error occurs, we may cancel and refund or contact you for instructions.
  • Made-to-order (POD): Most items are produced after you order. Production typically begins shortly after checkout.
  • Mockups & color: On-screen previews are visual mockups. Print color and placement can vary slightly due to fabric, inks, and calibration tolerances.
  • Cancellations: We offer a 2-hour grace period to request changes/cancellation after purchase. After production starts, cancellation isn’t guaranteed.

4) Payments (Stripe & Coinbase)

  • We accept major cards via Stripe and cryptocurrency via Coinbase Commerce (where available).
  • Crypto specifics: blockchain transactions are generally irreversible; network fees and price volatility apply. If a refund is approved, we may issue store credit or a crypto refund net of network/processing fees at the then-current exchange rate at the time of refund processing.
  • You authorize us (and our processors) to charge your selected payment method for your order total, taxes, duties, and shipping as applicable.

5) Shipping, risk of loss & international

  • Shipping times shown at checkout are estimates. We’ll provide tracking where available.
  • Risk of loss transfers to you upon delivery scan by the carrier. See our policies for help with lost/late packages.
  • International: recipients are responsible for import duties, VAT/GST, and customs clearance. These amounts are not collected by us unless explicitly stated.

6) Returns, exchanges & refunds

Our approach balances quality and sustainability for made-to-order goods. Please see our Refunds & Returns Policy for full details. Highlights:

  • Defects/misprints: free replacement or refund (report within the stated window with photos).
  • Change-of-mind: typically store credit; return shipping is customer-paid.
  • Exchanges: size/color exchanges available within the stated window if items are unworn and unwashed.

7) AI image tool & user content

We provide a generative AI “chat-to-image” tool that lets you create or upload artwork to print on products.

7.1 Your content & license to us

  • You retain any rights you hold in content you submit (prompts, uploads, text, images). You grant us a worldwide, non-exclusive, royalty-free license to host, reproduce, adapt, and print your content solely to fulfill your order, provide support, and maintain the Services. You can revoke this license by deleting your account or content, except to the extent retained for legal compliance or already incorporated into an order in production.

7.2 Outputs from the AI tool

  • Outputs are generated based on your prompts and system settings. Legal protection for AI-generated works varies by jurisdiction. As between you and us, we grant you a perpetual, worldwide license to use, reproduce, and commercialize the specific outputs you create via your account, subject to these Terms and any third-party rights.
  • Pre-made SquareSole designs and brand assets are not included in this license and remain our IP (see Section 8).

7.3 Your responsibilities

  • You represent and warrant that your prompts/uploads do not infringe others’ rights (copyright, trademark, publicity, privacy) and do not violate our Acceptable Use rules.
  • You agree not to request or print content that is illegal, hateful, harassing, sexually explicit involving minors, or otherwise prohibited.
  • You understand previews are mockups and small print/position variances can occur.

8) Intellectual property

  • All site content, trademarks, logos, and pre-made designs are owned by SquareSole or its licensors and are protected by IP laws. We grant you a limited, non-exclusive license to access the site for personal, non-commercial use. No rights are granted to copy, distribute, or create derivative works except as expressly allowed.
  • When you purchase a product featuring our original designs, you receive the physical product—not a license to reproduce the design on other goods.

9) Acceptable use

You agree not to:

  • Violate any law or third-party right; upload or generate content that is unlawful, defamatory, obscene, hateful, exploitative, or incites violence.
  • Upload personal data of others without permission, or content that includes minors in sexualized contexts.
  • Reverse engineer, scrape, or misuse the Services or interfere with security features.

10) Privacy & cookies

Our Privacy Policy and Cookie Policy explain how we collect and use data and how you can manage cookies/consent. By using the Services, you agree to those policies.

11) Disclaimers

  • Except as expressly stated, the Services and products are provided “as is” and “as available” without warranties of any kind. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
  • We do not warrant uninterrupted or error-free operation, or that the AI outputs will meet your expectations.

12) Limitation of liability

To the maximum extent permitted by law, SquareSole and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim relating to the Services or products will not exceed the amount you paid for the order giving rise to the claim.

13) Indemnity

You agree to defend, indemnify, and hold harmless SquareSole and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your content, use of the Services, or violation of these Terms or applicable law.

14) IP complaints / DMCA

If you believe content infringes your copyright or trademark, contact us with: (a) a description of the work/mark, (b) location of the allegedly infringing material, (c) your contact info, (d) a statement of good-faith belief, and (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act. 15) Governing law, arbitration & class waiver

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules.

  • Arbitration: Any dispute arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis administered by a recognized provider (e.g., AAA) in Hillsborough County, Florida, in English, unless you choose to bring the claim in small-claims court.
  • Class action waiver: You and SquareSole agree that each may bring claims only in your individual capacity and not as a class member or representative.
  • Injunctive relief: Either party may seek injunctive or equitable relief in court to protect IP or confidential information.

16) Changes to these terms

We may update these Terms from time to time. If we make material changes, we’ll post the update date above and, where appropriate, notify you. Continued use of the Services after changes means you accept the updated Terms.
